Baker Law, P.A. president Jonathon W. Baker, Esq. was quoted in the MG Magazine article, "Amended PACT Act Could Disrupt Vape Industry." The article discusses the ramifications that the Preventing Online Sales of E-Cigarettes to Children Act could have on CBD and THC vape sales.

As predicted in Baker Law, P.A.'s blog article "New Legislation Imposes Huge Burdens on Vape Retailers with Online Sales" published January 4, 2021, the new rules have proven burdensome for online sellers of vaping products and accessories. The new law adds electronic nicotine delivery systems, or "ENDS," to the definition of a "cigarette", thus bringing them under the purview of the Prevent All Cigarette Trafficking (PACT) Act. ENDS are broadly defined as “any electronic device that, through an aerosolized solution, delivers nicotine, flavor, or any other substance to the user inhaling from the device” and further includes specifically “any component, liquid, part, or accessory” [emphasis added] of such a device.


The registration, record-keeping, reporting and shipment requirements to remain in compliance are crushing, and small businesses have been forced to hire additional personnel simply to keep up with the paperwork, add the expense of a tax software compliance company such as IGEN (https://igentax.com/vape-tax-software/) or halt online sales of vaping products and accessories altogether.
