Florida Considers COVID-19 Liability Protection for Restaurants

Florida's Chief Financial Officer (CFO), Jimmy Patronis, along with Senator Keith Perry, have embarked on what Mr. Patronis has dubbed the "Restaurant Business Liability Tour." Florida's legislature meets in March 2021and the CFO is pushing for lawmakers to provide small businesses such as restaurants protection from lawsuits involving COVID-19, noting some corporations are already facing such lawsuits with what he described as "sue-and-settle tactics."

Fearing undesirable outcomes such as rising insurance rates and a "flood of attorneys" pursuing litigation, ultimately resulting in small businesses shutting down, the CFO vowed "[w]e can't let that happen, not in Florida.... [w]e must provide small business owners the confidence to be able to reopen without the fear of litigation."
